the content available on this site, including but not limited to:
photographs, illustrations, images, and text is owned by Timeless Images
Photography, Inc. unless otherwise specified.
All content on this site is protected by both United States of America and
International copyright laws. No form of reproduction, including the copying
or saving of any digital image, audio, video, or text files on this website
or the alteration or manipulation of any of said image, audio, video, or
text files is permissible. This content cannot be included in any other
publication or product, or any other website unless accompanied by a written
copyright release or written permission by Timeless Images Photography,
Inc..
DEPOSITS AND PAYMENTS
The Client shall make a deposit to retain the Photographer to perform the
services specified herein. At such time as this order is completed, the
deposit shall be applied to reduce the total cost and Client shall pay the
balance due. If the Client refuses delivery of the order or refuses to pay
within thirty days of this order, Client shall be in default hereunder and
shall pay percent interest on the unpaid balance until payment is made in
full.
CANCELLATION OF ORDERS
Our products are custom products that have no value other than to the
customer placing an order. Our products are not such, that they can be
replaced on a shelf for another to purchase. THEREFORE, ONCE
POSE CHOICES HAVE BEEN SUBMITTED, CUSTOM ORDERS MAY NOT BE CANCELLED.
PHOTOGRAPHIC MATERIALS
All photographic materials, including but not limited to digital files,
negatives, transparencies, proofs and previews, shall be the exclusive
property of Timeless Images Photography, Inc.. Timeless Images Photography,
Inc. may, with the Client's permission, make the images available on a Web
site for reviewing purposes only.
COPYRIGHT AND REPRODUCTION
Timeless Images Photography, Inc. shall own the copyright for all images
created and shall have the exclusive right to make reproductions. Timeless
Images Photography, Inc. shall have the right to make reproductions for the
Client or for Timeless Images Photography, Inc.'s portfolio, samples,
self-promotions, entry in photographic contests or exhibitions or for
industry editorial use. For consideration received, Timeless Images
Photography, Inc. retains the right to release all or some of their inherent
copyright privileges to a client and when doing so will transfer said rights
to the client or their assignee(s) through a written copyright release.
Without such release no release of copyright shall be considered in effect
or acknowledged.
FAILURE TO PERFORM
If Timeless Images Photography, Inc. cannot perform at any given event OR to
provide images or image compilations paid for by the client, whether due to
due to natural catastrophe, act of god, labor strike or other cause beyond
the control of the parties, or due to Photographer illness or injury, then
Timeless Images Photography, Inc. shall return any deposit made by the
client, back to the Client, but shall have no further liability with respect
any order or agreement. This limitation on liability shall also apply in the
event that photographic materials are damaged in processing, lost through
camera or computer related malfunction, loss in the mail, or otherwise lost
or damaged. In the event the Photographer fails to perform for any other
reason, the Photographer shall not be liable for any amount in excess of the
retail value of the Client's order.
PHOTOGRAPHER
Timeless Images Photography, Inc. withholds the right to schedule any of
their photographers for any given event. Photographer substitution may occur
at the discretion of Timeless Images Photography, Inc.in the event of
Photographer's illness or scheduling conflicts. In the event of such
substitution, Timeless Images Photography, Inc. warrants that the
photographer taking the photographs shall be a competent professional.
INHERENT QUALITIES
Client is aware that color dyes in photography may fade or discolor over
time due to the inherent qualities of dyes, and Client releases Photographer
from any liability for any claims whatsoever based upon fading or
discoloration due to such inherent qualities.
PRICING
Our charges for services may adjust periodically and orders shall be charged
at the prices in effect at the time when the order is placed.
MISCELLANEOUS
This Agreement incorporates the entire understanding of the parties. Any
modifications of this Agreement must be in writing and signed by both
parties. This Agreement shall be governed by the laws of the State of
Washington and the United States of America.
